Terms of service (TOS) for Zevio.com

Please read these Terms of Service (“TOS”, “Terms”) before using Zevio.com or any associated domain (The “service”).

Your access to and use of the Service is conditioned on your acceptance and compliance with these Terms. These terms apply to all former or present users and others who use The Service, regardless of membership type, user type, duration or other variables.

By using or accessing the Service you (The “User”, “Customer”) agree to be bound by these terms. Should you disagree or find yourself unable to comply with any part of The Terms, you may not use The Service and agree to terminate membership immediately.

Zevio.com has two types of users. ‘Viewers’ are people who have an account and use Zevio to watch webinars and partake in chats and other interactive features. ‘Broadcasters’ are people who share their ideas and promote/sell products on Zevio. Terms that apply to all users are simply using the terms ‘users’.

By using or accessing The Service users furthermore accept the processing of personal information necessary for us to provide the service. For more information on what data we process and to what end, please refer to our Privacy Policy

Zevio.com has the right to, at any point in time and without warning, delete users’ Account and content and remove access to the Service should they default on the terms laid out in this document. In this event, users will be notified of account closure via email.

Reasons for account suspension includes, but is not limited to:

General regulations

  1. The Service is available for natural person(s). To be a broadcaster users must be over the age of 18, or provide written acceptance of these terms by a legal guardian.

  2. The role of broadcaster is invite-only. To become a broadcaster, reach out to us at hello@zevio.com.

  3. Subscription to the Service is personal and may not be transferred to any other person, natural or otherwise.

  4. To use the Service you must have an internet-connected device. This is not provided by the Service. The Service has the right to change the technical requirements for usage of the Service at any time, without warning.

  5. Under no circumstance can Zevio.com be held responsible for any utterances made by any User within the service. Any and all reports of indecent, racist or otherwise inappropriate behaviour will be investigated and relevant steps taken to ensure that this will not continue.   6. Zevio.com has the right to terminate any account and ban any User who does not contribute to a good experience for all Customers. Zevio.com will not be responsible for any losses incurred by account termination.

The Service

  1. The Service is a place to create and send broadcasts and promote/sell associated products. Products may include, but are not limited to, books, event tickets, video courses and more.

  2. The Service may at its own discretion use third party services to provide parts of the Service. In this case, the user must read and accept the Terms provided by the third party service. Zevio.com assumes no responsibility for any provisions set forth in the TOS or any other place by any third party. Zevio will ensure that any third party services are used in compliance with European and Danish law.

Intellectual property rights

  1. Zevio.com may at its sole discretion engage in marketing activities intended to grow the member base. 

  2. These promotions may always include any event or product created by the users on our platform. By accepting the TOS laid out in this document, users acknowledge the right of Zevio.com to use pictures, text and more uploaded by users in Zevios marketing efforts without prior written consent.

  3. All logos and visual elements are the property of Zevio.com. They may not be used for commercial purposes without written permission from a legal representative of Zevio.com.

  4. An account with Zevio.com will never give the right to reproduce, sell or modify and content owned by - or made available on - Zevio.com

  5. Zevio.com holds no responsibility for misuse of material that Customers have shared on the Service and will not indemnify users for losses occured by actions of other Customers in the Service. If you feel that others users are violating your rights, reach out to us immediately at hello@zevio.com

Payment (Relevant for broadcasts)

  1. There is no charge to use the service for viewers. However, several add-ons are available for broadcasters. These may include but are not limited to: assistance in broadcasting webinars, selling products and goods and more.

  2. Users may upload products for sale on Zevio.com. In the event of sales, Zevio will retain 20% and forward the remaining 80% to users.

  3. Marketing and other fees are the sole responsibility of Zevio, and comes out of Zevios budget.

  4. Payouts to users who sell on the platform will be handled by Zevio, and account settled at the end of the month.

  5. Users are responsible for providing Zevio with the information necessary to enable transfers of funds, and must comply with any and all requests for identification paper issued by Zevio. 

  6. Delays in payouts due to missing information or other matters will not be compensated.

  7. Broadcasters are responsible for customer service. Emails and phone numbers of broadcaster organisations are forwarded to customers. In case of disputes, Zevio has final authority.

  8. Broadcasters are responsible for ensuring adequate protection for data received in order to fulfill contractual obligations (For instance addresses when receiving orders that need to be shipped.)

  9. Questions regarding payouts should be directed to finance@zevio.com.

Third parties

  1. The service may provide links, endorsements and other elements generated by other Customers or Zevio. These may link to third party websites. Under no circumstances can Zevio.com be held responsible for any damage or loss that occurs in relation to following these links or making use of these elements. Users are always solely responsible for activities undertaken on third party websites and services.

  2. Any third party officially used by Zevio.com may have their own Terms of Use. It is the sole responsibility of the User to review and decide whether to accept these. Not accepting third party Terms will render users unable to use our services.
     

Zevio.com’s rights and obligations

  1. The Service reserves the right to change and amend the Terms. All substantial changes, however, must be communicated to user no less than 30 days before the change is implemented.

  2. The Service may contact Customers for promotional purposes only when explicit content is given.

  3. Zevio.com aims at being permanently available. Downtime may however occur and shall not be considered as a breach of the Terms. If the Service is unavailable for a prolonged period of time, the Service may opt to contact users to clarify the situation. 

  4. Zevio will not indemnify users in case of technical difficulties of either broadcasters, viewers or zevio.com.

  5. All communication from the Service to Customers must be in compliance with the Privacy Policy of the Service.

  6. The service cannot be held responsible for any service outages due to local issues and/or outages of local service providers.

  7. The Service may at its discretion hire subcontractors. These must however always be in compliance with the privacy policy where applicable.

  8. The service is not limited to any specific geographic location, and members are welcomed from everywhere. However Zevio.com assumes no obligations to provide customers support or the Service itself in any other language than English.

  9. The Service is under no obligation to provide technical support for devices used to access or broadcast on Zevio. This includes Encoders, Transcoders, Lights, Streamdecks, Microphones, Cameras etc.

  10. Zevio may restrict or deny service to any users (broadcasters or viewers) in the case of misinformation, misleading information or the use of our platform to disseminate propaganda.

Customers rights and obligations

  1. As a Customer of Zevio you accept that you are not, under any circumstances allowed to disrupt, transform or copy any part of the Service or systems thereof for any purpose.

  2. As a Customer of Zevio you accept that you are bound by these terms and conditions.

  3. Users may not share material that is illegal, hateful or material, links or any other element that can compromise the safety of other Customers or other legal entities. Doing so will result in immediate account termination.

  4. The User accepts that any account cannot be transferred to another individual or organization.

  5. The User must at all times provide accurate information to Zevio.

  6. The User may at any time request a full and complete removal of all data the Service is not required by law to keep. Please refer to our Privacy Policy for all information regarding your personal information.

  7. When using interactive features such as, but not limited to, chatting, Zevio may remove the availability of such features from any given user - or ban the user entirely from the service. Do not spam, share unsolicited links or make profane or obscene comments.

  8. Customers may contribute to Zevio with their own content. If any Customer finds their Intellectual property being violated by other Users of Zevio, they shall immediately and without unnecessary delay inform Zevio.com, which reserves the right to investigate and act at its discretion to protect users, systems and intellectual property.

Disputes

  1. The Service is incorporated under the laws of Denmark and its courts. Any disputes must be attempted resolved between the parties or alternatively via the EU system for out-of-courts solution: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage 

  2.  Failing this, you may try the matter before the courts of Denmark.

  3. These Terms will not supersede any mandatory consumer protection laws in the Customers country of residence if these deviate from the above Terms.

Miscellanous

  1. Should you need to contact us, please write us at hello@zevio.com, or send us a letter at Zevio ApS, Flakhaven 1, 1.,  5000 Odense C, Denmark.
  2. In the case of discrepancies between our Terms and the Privacy Policy, the latter shall have legal precedence.
  3. If any of the clauses in the Terms are found to be unenforceable or void, this does not render any other clause in these terms void.
  4. Failure by Zevio.com to enforce any terms shall not render these terms void in any future situations, where similar terms may find use
